Terms and Conditions for the Ford Econo Driver Training

You should read and understand these Terms and Conditions before making a booking.  If you have any questions, please contact our Customer Care team on 01256 495731 or at FordEDT@AAdrivetech.com.

Definitions:

a) Booking: You can book your place on an Econo Driver Training by telephoning our Customer Care team on 01256 495731. By making a booking you are entering into a binding contract with AA DriveTech under these Terms and Conditions.

b) Payment: Payment can be made by most credit and debit cards, (American Express is not accepted by AA DriveTech) by telephone. We are unable to accept cheques, postal orders or cash. Full payment of the price of the Econo Driver Training must be made at time of booking.

c) Cancellation and rescheduling: You can cancel your booking and obtain a full refund any time during the cooling-off period.  If you cancel your booking any time after that we may retain part or all of the price you paid for the Econo Driver Training as a cancellation fee, depending on how much notice you give us, as set out below:


1) If you cancel more than 10 working days before the date of your Econo Driver Training, a cancellation fee of £20 including VAT applies.  If you choose to claim a refund, the cancellation fee will be deducted from that refund.  If you choose instead to reschedule, you will have to pay an administration charge of £12 including VAT in order to do so and rescheduling will be subject to availability.
2) If you cancel 10 working days or less before the date of your Econo Driver Training, you will not be entitled to a refund (except as expressly stated in these terms).  If you wish to book another Econo Driver Training you may do so (subject to availability) but on doing so,  you must pay the full price of the Econo Driver Training at the date that you contact us to book.

Cancellations, rescheduling and new bookings can be made by telephoning our Customer Care team on 01256 495731.

d) Transfer: You must participate in the Econo Driver Training yourself and cannot nominate or authorise someone else to attend in your place without our prior consent.  It is at AA DriveTech’s complete discretion as to whether it allows someone nominated by you to attend in your place.  That person must agree to be bound by these Terms and Conditions. If you wish to transfer your place, please telephone our Customer Care team on 01256 495731 at least 2 days before the date of the training.

e) Our responsibilities: AA DriveTech will provide you with the Econo Driver Training on the day and at the time and location you have booked. AA DriveTech will ensure that your assessor is suitably qualified and equipped to provide the Econo Driver Training. 

f) Your responsibilities: You are responsible for:

1) Arriving on time for the Econo Driver Training: If you arrive late you may not be allowed to participate (this will be at the discretion of the assessor), and you will not be entitled to a refund and, if you wish to rebook, you must pay the full price of the Econo Driver Training at the date you contact us to arrange the rebooking.  You will be expected to leave sufficient time for your journey allowing for general delays.

2) Bringing along everything you need to participate:

If you do not bring along any of these items on the day you may not be allowed to participate and will not be entitled to a refund.  If you wish to rebook your Econo Driver Training, you will have to pay the full price of the Econo Driver Training at the date you contact us to arrange the rebooking.

3) Ensuring your vehicle is in a roadworthy condition: You must ensure your vehicle is in a roadworthy condition on the date of the training. If your assessor reasonably considers that the roadworthiness of your vehicle is unsafe on the day, you will not be allowed to participate and AA DriveTech shall if it thinks it appropriate contact relevant enforcement authorities (e.g. the Police or DVLA). You will not be entitled to a refund.  If your vehicle breaks down during the Econo Driver Training you will not be entitled to a refund.  We do not provide a breakdown recovery service as part of the Econo Driver Training.

4) Being in a fit state to participate in the Econo Driver Training: Econo Driver Training is designed for drivers of all abilities.  However, if your assessor considers on the day for any reason that your participation in the Econo Driver Training would cause a danger to you or to any other person, you may not be allowed to participate.  If you are not allowed to participate AA DriveTech will provide you with reasons why.  We may provide you with a full or partial refund, depending on the reason why you cannot participate and how much of the course you have completed, but this is at AA DriveTech’s complete discretion. 

You will not be allowed to participate if you are under the influence of alcohol or drugs.  If you arrive at the location of the Econo Driver Training under the influence of alcohol or drugs you will not be allowed to participate and AA DriveTech shall if it thinks it appropriate contact relevant enforcement authorities (e.g. the Police). You will not be entitled to a refund.

You should not participate in the Econo Driver Training if you are unwell.  If you have to cancel the Econo Driver Training because you are ill, let us know as soon as possible by telephoning our Customer Care team on 01256 495731. If we are satisfied that you have cancelled because of genuine illness (and we may ask you to provide evidence of your illness, such as a doctor’s note), we will reschedule your Econo Driver Training (subject to availability) or provide a full refund.

g) Econo Driver Training cancellation or rescheduling by us: AA DriveTech may have to cancel or reschedule an Econo Driver Training for reasons outside of its control, such as icy conditions or if an assessor is ill.  If this happens we will give you as much notice as possible.  You will be entitled to book a place on another Econo Driver Training without any additional charge, or to claim a full refund.

h) Specific requirements: When booking Econo Driver Training, you must notify us of any disability or other special requirements likely to affect your participation in the Econo Driver Training.  Where possible, AA DriveTech will make suitable arrangements to accommodate these.  If AA DriveTech cannot accommodate your requirements AA DriveTech will let you know as soon as possible and, if this prevents you from participating in an Econo Driver Training which you have already paid for, we will give you a full refund.

i) AA DriveTech’s liability to you: Except as specifically set out in these Terms and Conditions, AA DriveTech will not compensate you for any losses you suffer resulting from our provision of or any failure by us to provide the Econo Driver Training, or from any decision by us to prevent you from participating in the Econo Driver Training for any reason.  AA DriveTech shall not in any event, and to the extent permitted by law, be liable to compensate you at all for:

1) any sum which exceeds the price that you paid for the Econo Driver Training; or

2) any losses which are caused by or arise out of your own fault, including a failure to act in accordance with directions from the assessor; or

3) any losses which are caused by or arise out the acts or omissions of a third party unconnected with our provision of the Econo Driver Training ; or

4) any losses which are caused by or arise out of events which we could not have foreseen or prevented, even if we had taken reasonable care; or

5) any losses relating to any business interests you may have, which includes (but is not limited to) any loss of profits, opportunity or business, or any interruption to your business; or

6) any financial losses resulting from AA DriveTech’s decision not to issue you with a certificate of completion for the Econo Driver Training, or from any comments regarding your driving competence or your car’s performance made (or not made) by an assessor on a certificate or otherwise; or

7) any other losses which do not arise directly out of our failure to perform our obligations with reasonable care and skill; or

8) any special, indirect or consequential loss whatsoever.

AA DriveTech does not limit or exclude its liability to compensate you for your death or personal injury if caused by our negligence, or any other liability to you which we cannot lawfully exclude or limit. 

Nothing in these Terms and Conditions will affect any statutory rights you may have as a consumer.


j) Use of personal information: We gather information about you and use information which you provide to us to handle bookings, process payments, communicate with you about the Econo Driver Training, deliver the Econo Driver Training and to prevent or detect fraud. k) Law applying to these Terms and Conditions: These Terms and Conditions are governed by English law.  Any claim relating to these Terms and Conditions must be brought in the English courts.

None of the terms and conditions are enforceable by anyone else other than you.  For the avoidance of doubt, the Contract (Rights of Third Parties) Act 1999, or any replacement or amendment of such Act, are excluded.
